Terms of Service

1. Acceptance of Terms

By accessing or using SiteIntel's feasibility intelligence platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

SiteIntel provides AI-powered feasibility intelligence for commercial real estate, including:

• Site feasibility reports with zoning, flood, utilities, and market data
• Data sourced from government agencies (FEMA, EPA, TxDOT, Census, etc.)
• AI-generated narrative analysis of feasibility factors
• PDF report generation and export

3. User Accounts and Registration

3.1 Account Creation

You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Fees and Payment

4.1 Pricing

• Pay-Per-Report: $999 per feasibility report
• Professional Plan: $1,950/month for 5 reports/month

4.2 Payment Terms

All fees are payable in advance via Stripe. Subscription fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice.

5. Data Accuracy and Disclaimers

5.1 Data Sources

SiteIntel aggregates data from third-party government sources (FEMA, EPA, TxDOT, Census Bureau, county CADs, etc.). We strive for accuracy but do not guarantee the completeness or accuracy of third-party data.

5.2 No Professional Advice

SiteIntel reports are informational tools, not professional advice. Our reports do not constitute legal, engineering, environmental, or financial advice. You should consult qualified professionals (attorneys, engineers, surveyors, environmental consultants) before making real estate decisions.

5.3 AI-Generated Content

Our reports include AI-generated narrative analysis. AI outputs may contain errors or omissions. You are responsible for verifying all information before relying on it.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Resell, redistribute, or sublicense reports without authorization
• Reverse engineer, decompile, or attempt to extract source code
• Use automated tools to scrape or harvest data
• Violate any applicable laws, regulations, or third-party rights

7. Intellectual Property

7.1 SiteIntel IP

The Service, including its software, design, and content (excluding user-submitted data and third-party data), is owned by SiteIntel and protected by copyright, trademark, and other intellectual property laws.

7.2 Report License

You receive a non-exclusive, non-transferable license to use reports you purchase for your internal business purposes. You may share reports with lenders, investors, and consultants in connection with the property analyzed.

8. Limitation of Liability

To the maximum extent permitted by law, SiteIntel shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service, including but not limited to lost profits, business interruption, or reliance on inaccurate data.

Our total liability to you for all claims arising from the Service shall not exceed the fees you paid in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless SiteIntel, its affiliates, officers, directors, and employees from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may cancel your subscription at any time, but fees paid are non-refundable.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Travis County, Texas, in accordance with the American Arbitration Association rules.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
